Terms of Use
This USER Agreement (the "Agreement") and the policies referred to herein contain the complete terms and conditions that apply to your use of the restaurant reservation services (the "Services") being offered at the URL: http://www.cafedecogroup.com and all affiliated web sites owned and operated solely by Cafe Deco Group restaurants (collectively, the "Cafe Deco Group Site"). As used in this Agreement, "Cafe Deco Group" refers to International Restaurants Holdings Limited and all of its restaurant subsidiaries and "USER" or "you" refers to you. USE OF THE SERVICES AND THE OPENTABLE SITE CONSTITUTES KNOWING ACCEPTANCE AND ACKNOWLEDGEMENT OF THIS USER AGREEMENT, OPENTABLE'S PRIVACY POLICY, AND OPENTABLE'S DINING REWARDS TERMS AND CONDITIONS.
Cafe Deco Group Site may modify this Agreement's terms and conditions at any time without notice. Continued use of the Services and the Cafe Deco Group Site after a change in this Agreement, a change in the Privacy Policy, or after implementation of any other new policy constitutes acceptance of such change or policy.
1. OVERVIEW
Cafe Deco Group provides the Services to USER for the purpose of assisting USER in i) securing dining reservations at Cafe Deco Group’s restaurants (each a "Restaurant"), and ii) logging in the Café Deco Group’s VIP area.
In response to a USER's online request, the Cafe Deco Group Site directly contacts the Restaurant's computerized database of reservations. The availability of reservations is determined at the time of USER's query. Once a reservation is made by USER, Cafe Deco Group will provide confirmation of the reservation to USER by email, within business hours. If a reservation is made after business hours, the confirmation of the reservation to USER will be made on the next business day, in the order it was received. By using the Services, USER agrees to receive reservation confirmations by email after booking a reservation through the Cafe Deco Group Site.
A USER is also enabled to access the restricted VIP area of the Cafe Deco Group website via a password-protected login session, where the USER’s account information, frequent diner’s membership level, account status, redemption request and history are available.
2. NO SHOW POLICY
Cafe Deco Group is committed to providing superior quality services to its USERS and Restaurants. To assist us in maintaining a consistently high level of service with the Cafe Deco Group’s restaurants and patrons, USERS are asked to cancel any reservations that they will be unable to honor at least 30 minutes in advance on the day of the reservation. You may cancel your reservation online or call the restaurant directly. In the case of larger party reservations, where the restaurant has requested a credit card and/or a deposit in advance, you may be required to cancel your reservation in accordance with that restaurant's individual cancellation policy, which will always be shared with the USER at the time the reservation is made.
If you are unable to keep your reservation and you fail to cancel, Cafe Deco Group may send you an email letting you know that our records indicate that you were a no-show. By using the Services, USER agrees to receive no-show confirmations by email after a Restaurant and/or the Cafe Deco Group Site reports your reservation was not honored, whether or not that was in fact the case. Your Cafe Deco Group account will be terminated if you no-show for four reservations within the same twelve-month period. If you receive a no-show confirmation email in error, please email us at reservation@cafedecogroup.com and our support staff will assist you with resolving the error. USER agrees that all final no-show determination will be made by Cafe Deco Group in its sole discretion.
3. PRIVACY POLICY
Cafe Deco Group is committed to safeguarding your privacy online. Please review our privacy policy.
4. USAGE GUIDELINES
The Services are being offered to USER for USER's personal use. USER agrees to use the Services only to book reservations at Cafe Deco Group’s Restaurants and then honor those reservations by arriving at the Restaurant(s) on time and ordering and paying for a meal. USER further agrees not to book more than one (1) reservation for USER's personal use during any one meal time (e.g., lunch, dinner, etc.).
Any and all other uses which are unlawful or in violation of this Agreement's terms and conditions are prohibited.
5. CAFE DECO DINING REWARDS
USER may be able to participate in Cafe Deco Group website’s USER benefits program, Cafe Deco Group Rewards. Participation is subject to Cafe Deco Group’s Frequent Diner Reward Policy.
6. EMAIL POLICY
You may receive periodic emails from Cafe Deco Group if you opted to receive such email at the time of activation of your Cafe Deco membership card (also referred to as “Red Card”). If you would rather not receive email from Cafe Deco Group, please send an email to unsubscribe@cafedecogroup.com and you will be unsubscribed from receiving further mailings. USER acknowledges and agrees, however, that USER will still receive reservation confirmation emails, no-show confirmation emails, reservation change confirmation emails, reservation cancellation confirmation emails and other emails relating to reservations booked by USER through the Cafe Deco Group Site, even if USER has opted not to receive periodic email from Cafe Deco Group. You will never receive email from third party non-affiliated with Cafe Deco Group, in accordance with our Privacy Policy.
7. INTELLECTUAL PROPERTY AND GRANT OF RIGHTS TO USER
The materials and services provided for and depicted on the Cafe Deco Group Site are protected by copyright, trademark, patent and other intellectual property laws. All text, graphics, video, data or other content on the Cafe Deco Group Site ("Cafe Deco Group Content") is provided to USER by Cafe Deco Group for the sole purpose of using the Services. USER shall not copy, display, modify, create derivative works of, publish, or sell the Cafe Deco Group Content or any information, software, or services provided by Cafe Deco Group hereunder. The Cafe Deco Group Content may be modified from time to time by Cafe Deco Group in its sole discretion. Except as expressly set forth herein, no license is granted to USER for any other purpose, and any other use of the Services or the Cafe Deco Group Content by USER shall constitute a material breach of this Agreement. Nothing in this Agreement shall affect any rights of Cafe Deco Group or its licensors in the Services or Cafe Deco Group Content, and any associated patents, trademarks, copyrights, mask work rights, trade secrets or other intellectual property rights. No license, right or interest in any trademarks of Cafe Deco Group or any third party is granted under this Agreement.
8. ACCESS AND INTERFERENCE
Much of the information on the Cafe Deco Group Site is updated on a real time basis and is proprietary or licensed to Cafe Deco Group by its Restaurants or third parties. By using the Cafe Deco Group Site, you agree not to:
Take any action that imposes or may impose (in Cafe Deco Group’s sole discretion) an unreasonable or disproportionately large load on our infrastructure.
Implement any manual processes to monitor or copy Cafe Deco Group Content from the Cafe Deco Group Site without express written permission.
Utilize any device, software or routine that will interfere or attempt to interfere with the functionality of the Cafe Deco Group Site.
9. LIABILITY LIMITATIONS
IN NO EVENT SHALL CAFÉ DECO GROUP BE LIABLE FOR ANY INJURY, LOSS, CLAIM, DAMAGE OR ANY SPECIAL, EXEMPLARY, PUNITIVE, INCIDENTAL OR CONSEQUENTIAL DAMAGES OF ANY KIND, WHETHER BASED IN CONTRACT, TORT OR OTHERWISE, WHICH ARISES OUT OF OR IS ANY WAY CONNECTED WITH ANY USE OF THE CAFÉ DECO GROUP SITE OR THE CAFÉ DECO GROUP CONTENT
10. DISCLAIMER OF WARRANTY
THE INFORMATION, PROGRAMS, PRODUCTS, AND MATERIALS CONTAINED IN OR ACCESSED ON THE CAFÉ DECO GROUP SITE, INCLUDING, WITHOUT LIMITATION, THE SERVICES AND THE CAFÉ DECO GROUP CONTENT, ARE PROVIDED TO USER ON AN 'AS IS' BASIS AND WITHOUT WARRANTY OF ANY KIND.
